McDonald’s Free of California Workers’ Class Wage Claims

Three McDonald’s workers in Oakland, Calif., can’t pursue claims against the franchiser on behalf of a proposed class for alleged theft of overtime, missed breaks, and unpaid time and expense for cleaning their uniforms, a federal judge ruled (Salazar v. McDonald’s Corp., 2017 BL 76446, N.D. Cal., Case No. 14-cv-02096-RS, 3/10/17).

The decision rejects the workers’ last remaining bid to show that McDonald’s Corp. should be held liable as their employer under California labor law for the alleged violations. The workers previously settled their claims against the owners of the various Oakland-area McDonald’s franchises where they work.
