Liberty Mutual $7 Million Overtime Suit Stays in Federal Court

Liberty Mutual Group Inc. convinced a federal court in California to retain jurisdiction over a proposed class action alleging that more than 100 sales representatives were subjected to unpaid overtime, missed breaks, and other state labor violations.

The insurance company established that the claims alone are worth more than $5 million, using reasonable calculations and declarations provided by business and payroll staff who examined the company’s employment records, Judge Cormac J. Carney said.

That amount exceeds the Class Action Fairness Act’s $5 million benchmark without even factoring in potential attorneys’ fees, which could exceed $1.3 million, the court noted. Altogether,...
