Lawyers Ask DOL to Reinstate Bush-Era Opinion Letters

Management attorneys are urging the Labor Department to reinstate legal opinion letters from the previous GOP administration that were withdrawn early in Barack Obama’s presidency, according to documents obtained by Bloomberg BNA.

The DOL’s Wage and Hour Division recently restored the process, after a more than eight-year hiatus, by which employers and employees can request opinion letters on fact-specific scenarios. Over the ensuing weeks, four management-side lawyers and one corporate chair have separately called on the WHD to reissue various guidance letters interpreting overtime and minimum wage laws.
