Performance Food Group Co. last year settled Labor Department claims that it discriminated against women and minorities in hiring at four locations in four states. Ten months later, the settlement was quietly expanded to encompass more than 60 of the company’s facilities nationwide.
Several attorneys who have worked with the DOL’s Office of Federal Contract Compliance Programs called that development unusual. They said amendments to settlements are rare occurrences that usually focus on small issues, such as an incorrect date. Substantive amendments in a new fiscal year to loop in more job sites are unheard of, they said.
