Labor Department Seeks to End Data Miner’s Health Plan Lawsuit

The Labor Department asked a federal judge in Texas to end a lawsuit by two data mining partnerships that sought the department’s blessing to offer health plans covering the people who’ve agreed to have their personal data tracked.

The department defended its advisory opinion concluding that the health plans proposed by Data Marketing Partnership LP and LP Management Services LLC aren’t governed by the Employee Retirement Income Security Act, because the “partners” they cover aren’t employees that perform work for the partnerships.
