Labor Board’s Top Lawyer Backs Return of ‘Blocking Charge’ Rule

NLRB General Counsel Jennifer Abruzzo “fully supports” the board’s proposal to reinstate its blocking charge policy, which allows for a pause in processing a union election petition if an unfair labor practice charge alleges conduct that would interfere with a fair vote.

The National Labor Relations Board should rescind a Trump-era rule that effectively eliminated the policy, thus forcing workers to vote in a coercive atmosphere, Abruzzo said in comments filed to the board’s rulemaking docket by last week’s deadline. She also noted the drain on agency resources to conduct tainted elections.
