The Eighth Circuit was right to vacate a federal court’s preliminary injunction that had blocked the Biden administration from enforcing its vaccine mandate for health-care workers in 10 states, the HHS told the US Supreme Court Tuesday.
The US Court of Appeals for the Eighth Circuit resolved the government’s appeal in April, vacating the injunction and handing decision-making back to the US District Court for the Eastern District of Missouri. The states, led by Missouri, then asked the Supreme Court to review the appellate court’s ruling .
