Judge Blasts Brethren for Not Reviewing LGBT Discrimination

Whether federal law protects gay and lesbian individuals from employment discrimination won’t be taken up by the full U.S. Court of Appeals for the Eleventh Circuit.

The court decided July 18 to stick by a panel holding that “discharge for homosexuality isn’t prohibited by Title VII” of the Civil Rights Act of 1964.

But Judge Robin S. Rosenbaum chastised the court for not taking the issue en banc, which would allow the court to overturn prior precedent.
