A group of immigrant investors can sue a Vermont agency that partnered with and oversaw a project that had misappropriated their money, the Vermont Supreme Court ruled in the latest case to come out of the downfall of the state’s Jay Peak ski resort project.
The investors, all of whom sought green cards through the EB-5 immigrant investor program, can sue the Vermont Agency of Commerce and Community Development for negligence, negligent misrepresentation, and breach of contract, the court said in an Oct. 4 decision.
Two former agency officials also can be sued for gross negligence, it said.
