Illinois County Worker Denied Telework for Covid Risk Can Sue

DuPage County, Ill., must face the claim of a one-time county home inspector who alleges he was denied continued remote work as an accommodation for the Covid health risks he allegedly faced because of his lung dysfunction, a federal judge in Chicago ruled.

Gerald Gentile can also pursue interference and retaliation claims under the Family and Medical Leave Act based on his attempt to take job-protected leave because of his condition and the county’s return-to-in-person-work order, the U.S. District Court for the Northern District of Illinois said.
