Illinois County Not Liable for State’s Alleged Rights Violations

Macon County, Ill., evaded liability Nov. 7 for allegedly firing a State Attorney’s Office employee in violation of her constitutional rights, because the state had control over the internal operations of the office, the Seventh Circuit said.

Amanda Burger, who worked in the Macon County SAO for about six years beginning in 2010, said she was fired after reporting a superior for alleged violations of state and federal employment laws. She sued over the alleged retaliation, and challenging the official explanation that she was fired for being married to someone with a criminal record.
