IBM Says Workers Lack Ingredients for Class Age Bias Case

Four former IBM Corp. employees who allege the company has systemically ridden itself of workers 40 and older shouldn’t be allowed to pursue their claims as a class, the company told a federal judge in New York.

Edvin Rusis, Henry Gerrits, Phil McGonegal, and David Ho Eng aren’t similarly situated to each other or the other employees they seek to represent in the class case they filed against the company, IBM said.

The former employees’ attorney, Boston-based Shannon Liss-Riordan, said at the time the lawsuit was filed in September that the class could ultimately include thousands of workers.
