Health Plan, Universities Want Transgender Bias Suit Tossed

The North Carolina State Health Plan for Teachers and State Employees doesn’t unlawfully discriminate against transgender employees and their dependents, plan officials told a federal court.

State Treasurer Dale Folwell, health plan administrator Dee Jones, and the plan July 8 asked the U.S. District Court for the Middle District of North Carolina to dismiss a lawsuit accusing the plan of violating the U.S. Constitution’s Equal Protection Clause and the Affordable Care Act’s nondiscrimination provision, Section 1557.
