Health-Care Worker OT Appeal Ruling Distinct From Federal Rule

An appeals court ruling against overtime pay for home health-care workers in Colorado reflects a national tension in a rapidly growing industry historically excluded from certain labor laws.

The U.S. Court of Appeals for the Tenth Circuit ruled Wednesday that staffing company Maxim Healthcare Services Inc. won’t have to pay $2.7 million in unpaid wages to a group of health-care workers, clarifying the reach of an exemption under a Colorado state law that blocks certain workers in the industry from overtime benefits.
