Foreign Student Beats U.S. in Work Program Papers Scrap

A U.S. Citizenship and Immigration Services’ decision to deny a foreign student the change to correct his application for the optional practical training program was “arbitrary and capricious,” an Alabama federal court ruled.

The agency erred when it requested additional evidence from Burmudan Rodney Smith to prove he had maintained lawful F-1 visa status throughout his degree program at Alabama A&M, but didn’t tell him that his school administrator had made mistakes in his petition that ultimately led to its rejection, Judge C. Lynwood Smith Jr. of the U.S. District Court for the Northern District of Alabama ruled Friday.
