Florida Trauma Surgeon Loses Appeal Claiming Retaliatory Firing

A trauma surgeon in Florida who says she was fired for taking time off to address mental health symptoms couldn’t convince the Eleventh Circuit to reinstate her Family and Medical Leave Act lawsuit.

Sufficient evidence supports the Middle District of Florida’s finding that Nelayda Fonte was fired because she violated trauma-patient transfer rules on two occasions in 2018, not because she used FMLA leave, the appeals court said Wednesday in a per curiam opinion.
