Florida Nurse Gets New Hearing in License Revocation Dispute

Florida’s nursing board pulled a “bait-and switch” by revoking a nurse’s license based on an aggravating factor that wasn’t charged in the complaint against her, a state appeals court said.

Kimberly McQueary will get a new hearing, as the Florida Board of Nursing violated her due process rights by imposing a penalty for violating patient confidentiality when she’d been charged only with having her license suspended in another state, the Florida District Court of Appeals, First District, said.
