A federal appeals court reversed a lower court ruling denying two former Boston Gas Co. workers their right to take their claims of underpaid pension benefits to arbitration.
The three-judge panel for the US Court of Appeals for the First Circuit Tuesday remanded the case to the US District Court for the District of Massachusetts and directed the court to grant the retirees’ request for arbitration.
The district court had ruled that a deadlocked vote over the arbitration claim by the company’s joint pension committee didn’t apply because the panel didn’t have the authority to rule on grievances.
