Female Corrections Officer Gets New Shot at Sex Assault Lawsuit

A woman who worked as a corrections officer in Texas will get a new chance at her lawsuit accusing three of her former coworkers of sexually assaulting her, after the Fifth Circuit held that the lower court wrongfully tossed the case without any potential repleading.

Tiffany Carver, who worked at the Stiles Unit of the Texas Department of Criminal Justice, sued Rodrick Atwood, Herman Smith, and Keith Watson in 2019. None of the three individual defendants had attempted to defend the suit in any way by December 2020, so the clerk entered a default, according to court records.
