Feds Support Alaska Air Appeal Challenging Attendant Breaks (1)

Alaska Airlines and Virgin America should win reversal of a ruling that flight attendants must be provided breaks at airports between intrastate flights in California, the federal government told the Ninth Circuit.

The California law requiring employers to provide rest periods is preempted by federal aviation law, the Department of Justice said in a friend-of-the-court brief filed in the U.S. Court of Appeals for the Ninth Circuit. Virgin America operated between 2007 and 2018, when it was integrated into Alaska Airlines.
