EEOC Withdraws Motion to Yank Authority From General Counsel (1)

The Equal Employment Opportunity Commission’s general counsel will continue to have authority over most decisions in workplace discrimination litigation brought by the agency—for now.

Commissioners withdrew a vote on a proposal to reclaim power over which lawsuits the agency will pursue, or into which cases they’ll intervene, sources familiar with the situation told Bloomberg Law. Currently, the commission delegates those decisions to the Office of the General Counsel, which brings potential lawsuits to a full commission vote only if the cases meet certain criteria, such as involving a novel area of law or affecting a large number of workers.
