Drivers’ Pay Violation Suit Against Amazon Advances

Amazon.com Inc. can’t duck a Fair Labor Standards Act collective action alleging drivers weren’t paid minimum wage and overtime.

Gregory Gibbs and Tatonya Huggins alleged enough detail about their hours and pay to state FLSA claims, the U.S. District Court for the Middle District of Florida said in refusing to dismiss the suit.

The plaintiffs may proceed against Amazon as their joint employer with defendants MLK Express Services LLC and AG Plus Express LLC, which hired them to deliver packages and unload trucks for Amazon, the court said.
