DISH Network Prevails in Wage Fight With Dallas Technician Union

DISH Network Corp. didn’t violate federal labor law by implementing its final offer without a genuine impasse in bargaining negotiations with a union representing technicians at two of its Dallas-Fort Worth locations, the Fifth Circuit said.

Insufficient evidence supported the National Labor Relations Board’s overruling of DISH’s impasse decision, the U.S. Court of Appeals for the Fifth Circuit said Friday.

The board erred in finding that the union waived a “white flag” in response to the company’s stated last offer that the performance-based payment plan be off the table.
