DISH Engineering Manager Not Exempt From Arbitration Pact

A Utah worker must arbitrate his claims that DISH Network LLC subjected him to discrimination, harassment, and retaliation for complaining, a federal court ruled.

As a staff engineering program manager, Nagendra Singh didn’t fall under the Federal Arbitration Act’s “transportation worker” exemption, the U.S. District Court for the District of Utah said July 11. The exemption bars the enforcement of employment arbitration agreements against railroad and other workers similarly engaged in interstate or foreign commerce, the court said.
