DHS Final Rule Gives Work Authorization
To H-4 Spouses of Certain H-1B Visa Holders

Effective May 26, the H-4 dependent spouses of certain H-1B highly skilled guestworkers will be able to apply for employment authorization under a final rule issued Feb. 24 by the Department of Homeland Security.

Scheduled for publication in the Feb. 25 Federal Register, the final rule grants employment authorization to the H-4 dependent spouses of H-1B workers who either are the beneficiaries of an approved I-140 immigrant petition for an alien worker or whose H-1B status has been extended under the American Competitiveness in the Twenty-first Century Act of 2000 (AC21), as amended by the 21st Century Department of Justice ...
