Data Miner Fights for Blessing of Health Plan Covering 50,000

A Georgia partnership that collects and sells personal data online renewed its bid to sponsor ERISA-covered health plans for the “partners” who’ve agreed to have their data tracked, telling a federal judge in Texas that these partners are active participants in a “legitimate and innovative business model.”

Data Marketing Partnership LP and LP Management Services LLC object to a Jan. 24 advisory opinion in which the Department of Labor concluded that their health plans aren’t governed by the Employee Retirement Income Security Act because the partners they cover don’t perform any work for the partnership.
