Data Miner Seeks Court OK on Health Plan After DOL Declined (1)

A Georgia partnership that collects and sells personal data online renewed its bid to sponsor ERISA-covered health plans for the “partners” who have agreed to have their data tracked, asking a federal judge in Texas to issue a temporary restraining order against the Department of Labor.

Data Marketing Partnership LP and LP Management Services LLC say they face “catastrophic regulatory penalties and enforcement actions” following a Jan. 24 advisory opinion in which the DOL said their health plans don’t qualify as single-employer plans under the Employee Retirement Income Security Act.
