Court Affirms Dismissal of EEOC Class Suit,
But Nixes Employer’s $4.5 Million Fee Award

A federal district court properly dismissed the Equal Employment Opportunity Commission’s purported sexual harassment class action on behalf of some 67 female tractor-trailer drivers under Title VII of the 1964 Civil Rights Act when EEOC failed to investigate or attempt to conciliate those women’s claims before filing suit, a divided U.S. Court of Appeals for the Eighth Circuit ruled Feb. 22 (EEOC v. CRST Van Expedited Inc.).
