Costco Manager With Fibromyalgia, Depression to Get Bias Trial

A Costco warehouse in Minnesota may have denied a receiving manager an accommodation for her fibromyalgia, depression, and anxiety after she returned from medical leave, a federal judge ruled.

A jury must decide whether Costco Wholesale Corp. violated Melinda Rose’s rights under the Minnesota Human Rights Act, the U.S. District Court for the District of Minnesota said Monday.

According to Costco, Rose could no longer perform all of the essential functions of her job, including lifting 50 pounds occasionally and using a forklift. The MHRA doesn’t require it to excuse her from performing essential duties, the company said.
