Construction Worker’s Fatal Fall Justified Fine, 11th Cir. Says

OSHA properly issued a citation and $101,399 fine against a Florida construction company stemming from a worker’s fatal fall, the Eleventh Circuit ruled.

Edwin Taylor Corp. of Tampa, Fla., had told the U.S. Court of Appeals for the Eleventh Circuit in Atlanta there was insufficient evidence to prove the company had violated the Occupational Safety and Health Administration’s fall protection rules.

The three-judge panel on Tuesday unanimously rejected that argument and said the agency’s finding of a willful construction safety violation was justified.
