Connecticut State Employees Can’t Get Union-Fee Suit Revived

A group of Connecticut state employees lost their bid to recover public union fees, after the Second Circuit ruled Wednesday that their claims are barred by the union’s good-faith reliance on then-valid law.

The Service Employees International Union affiliate reasonably relied on directly applicable U.S. Supreme Court precedent and Connecticut laws that authorized it to collect the fees from non-members until 2018, the U.S. Court of Appeals for the Second Circuit held.

Although the Supreme Court reversed course in Janus v. AFSCME, the union isn’t liable here because it collected the fees in good faith, the Second Circuit said....
