Coke Bottler Loses Its Challenge to Top NLRB Lawyer’s Authority

The National Labor Relations Board rejected a bid by the largest Coca-Cola bottler in the U.S. to escape unfair labor practice allegations based on its argument that the agency’s top lawyer can’t prosecute the case.

The NLRB said Wednesday that it won’t rule on challenges to Acting General Counsel Peter Sung Ohr’s authority, which formed the basis of Coca-Cola Consolidated Inc.’s motion to dismiss the case against it. The board explained in an order last week that it would leave the issue for federal courts to decide.
