A group of servers for an Illinois restaurant operator are entitled to summary judgment on their claim that the operator violated wage and hour laws by paying them less than minimum wage without properly informing them of its intent to take a tip credit. Although the operator claimed that it notified potential servers during the interview process that they would be compensated "$4.95 per hour plus tips,” it didn’t show that it told them how much less that cash pay was than minimum wage or that it would make up the difference between the minimum wage and the cash pay...
