Case: Labor Relations/Refusal to Bargain (N.L.R.B.)

The NLRB upheld the decision of an ALJ stating that a national drug store and pharmacy chain implemented what it claimed to be its “last, best, and final offer” for a successor collective bargaining agreement at one of its California locations without first bargaining with the union to an overall good-faith impasse in violation of the NLRA. The ALJ stated that there was overwhelming evidence that the union was willing to negotiate, which negated the employer’s claim of a bona fide impasse.
