Case: Labor Arbitration/Out-of-Unit Work Transfer (Arb.)

Arbitrator George L. Fitzsimmons ruled that Cummins Inc. didn’t violate its CBA prohibiting the performance of bargaining unit work by non-unit members and an appended letter of understanding by allowing central customer care center employees to place external original equipment orders on behalf of the St. Louis and Fenton, Missouri branches staffed by six bargaining unit parts specialists.
