Arbitrator Robin A. Romero ruled that U.S. Customs and Border Protection must provide back pay in the amount that would have been earned to an officer who—after he had been placed on administrative duties per his doctor’s recommendation—the agency admits was wrongfully required to surrender his firearm without the necessary notice that would have allowed him to immediately contest this action. Evidence showed, however, that there were no administrative shifts available to the grievant in addition to his regular administrative shifts except for a one-hour shift of administrative duty at one office.
