A federal court in Michigan granted summary judgment to Minnesota plastics manufacturer Diversified Plastics, Inc. on a former sales engineer’s unjust enrichment and Michigan Sales Representative Commission Act claims. Diverse Plastics agreed that the sales engineer would receive a 3% commission on all completed sales in his territory. The sales engineer claims that his commission was first governed by a written contract, and later replaced by a verbal agreement with the same terms.
