The Tarrant County Workforce Development Board, also known as Workforce Solutions, isn’t entitled to sovereign immunity on discrimination and retaliation claims under the Americans with Disabilities Act of a disabled employee it fired six months before she would’ve been eligible for retirement. The employer had reneged on a settlement agreement and allegedly used her personal information in violation of the Fair Credit Reporting Act. Workforce Solutions claimed it was dependent on public funding, but the local board didn’t specify that its funding was from state funds, and it didn’t show how a judgment against a local board could be passed ...
