Case: Individual Employment Rights/Noncompete Agreements (E.D. La.)

A former employee of a Louisiana property and casualty insurance agency is not entitled to dismissal of the breach of contract claims of the successor that acquired all the assets of his former employer in a sale, including his employment contract which contained a noncompete clause, a federal court in Louisiana determined. The employee resigned from his job without notice to work for a direct competitor after the asset sale, and he allegedly forwarded confidential and proprietary information to his personal email accounts. The successor company has standing to pursue enforcement of the noncompete agreement against him, the court said....
