The New Orleans Fire Department had just cause to discipline a firefighter for breaching an agreement not to use alcohol during his employment, which he entered through an Employee Assistance Program following his DWI arrest while off-duty, and a civil service commission didn’t err by finding his actions impaired the efficient operation of the department, or by discharging him and denying his appeal of his termination, a Louisiana Court of Appeal ruled. The commission noted he had a history of alcohol abuse, he knowingly violated the agreement, and the agreement pertained to both on and off-duty conduct, the court said. ...
