A federal district court in Texas properly granted summary judgment to Houston Methodist Hospital on the claim of a White former senior transportation analyst that he was discharged because of his race, rather than because an investigation found that he had sexually harassed a job applicant, the Fifth Circuit ruled. The employee failed to identify a co-worker of a different race who either replaced him or engaged in similar misconduct and was treated more favorably, the court said.
