Case: Disability Discrimination/Failure to Accommodate (S.D. Fla.)

A former “houseman” for Key Largo Management Corporation in Florida with diabetic retinopathy may not proceed with his claim that the corporation failed to properly accommodate his disability when it denied his requests to only be scheduled for day shifts, a federal district court said. He didn’t show that he was suffering from a “disability” under the Americans with Disabilities Act because none of his major life activities were limited by the diabetic retinopathy, given that his only restriction was an inability to drive at night.
