The Southern District of New York properly concluded that the Queens Health Center articulated a legitimate and non-discriminatory reason for terminating a part-time Obstetrics and Gynecology physician who took short-term disability leave after he suffered various injuries from a slip-and-fall accident—time theft based on two doctor’s appointments for his own medical needs that he attended during his shift. The closeness in time (six weeks) between when his supervisor first learned of his disability and her email recommending his termination to the Chief Medical Officer is insufficient alone to show evidence of pretext, the court said.
