Old Dominion Freight Line Inc. isn’t entitled to summary judgment on a claim by a maintenance manager that he was discharged because he required further surgery and time off after his stomach and liver cancer returned, rather than for falsifying the time records of his subordinates. Under Washington’s Law Against Discrimination the manager doesn’t have to show he was replaced by a non-disabled employee to establish a prima facie case of disability discrimination, just that Old Dominion admits it didn’t eliminate his position after firing him.
