California Truckers Forge On in Worker-Classification Battle

California Attorney General Xavier Becerra (D) and the Teamsters convinced a federal judge to dismiss some, but not all, of a trucking association’s challenges to the state’s controversial worker-classification law.

But the union couldn’t persuade the court to lift the injunction blocking enforcement of AB 5 against California truckers.

The California Trucking Association already established a likelihood of success on its claim that the Federal Aviation Authorization Administration Act expressly preempts AB 5, although it hasn’t plausibly alleged its other claims, Judge Roger Benitez of the U.S. District Court for the Southern District of California said Monday.
