California Trade Group Drops Appeal Over City’s Pandemic Pay Law

The California Grocers Association is dropping its fight to block a Long Beach, Calif., ordinance requiring that retailers pay workers an extra $4 an hour premium pay during the coronavirus pandemic.

Long Beach’s measure expired, prompting the trade group, whose members include Albertsons Cos Inc., Costco Wholesale Corp., and Whole Foods Market Inc., to file a motion to dismiss Wednesday in the U.S. Court of Appeals for the Ninth Circuit.

The appeal is moot, the group said in asking the court to dismiss without prejudice, meaning the lawsuit could be refiled.
