California May Require Bosses to Ignore Off-the-Clock Cannabis

Employers in California, where marijuana has been legal for years, would be prohibited from disciplining workers for consuming cannabis on their time off under legislation headed to Gov. Gavin Newsom Tuesday.

If signed into law, the measure (A.B. 2188) by Assemblymember Bill Quirk (D) would make California the seventh state to restrict the ability to penalize employees when a drug test comes up positive for the presence of cannabis byproducts. The Assembly sent Newsom (D) the bill on a 41-15 vote after the Senate passed it 27-11. It would go in effect on Jan. 1, 2024.
