California Justices to Resolve State Court Split on PAGA Claims

The California Supreme Court will settle a dispute involving a unique law allowing workers to sue their employers on behalf of the state.

After conflicting opinions from two California appellate courts, the justices will decide whether courts have authority to ensure that claims under the Private Attorneys General Act will be manageable at trial, and to dismiss claims that can’t be managed.

California’s top court will consider the question in the case of workers at several Royal Carpet Mills Inc. facilities who sued the company for meal and rest break violations, among other wage and hour claims.
