Broadband Property Damage Investigators Revive Overtime Lawsuit

Two OSP Prevention Group workers tasked with investigating damage to Comcast Corp. broadband infrastructure won the revival of their lawsuit seeking overtime wages when the Eleventh Circuit ruled Monday that they weren’t administrative employees and were therefore covered by the Fair Labor Standards Act.

Philip Fowler and Jeffrey Swans were “primarily engaged in factfinding investigative work” and didn’t settle claims or develop business strategies, the US Court of Appeals for the Eleventh Circuit said.
