Boeing, Ex-Worker Headed to Trial Over Disability Accommodation

The Boeing Co. may have prematurely stopped trying to find an employee a new job after his nervous system disorder left him unable to perform the job he held for five years, a federal judge ruled.

That a potentially suitable position became available after David Pallies was no longer working for Boeing isn’t fatal to his disability bias claim under Washington state law, the U.S. District Court for the Western District of Washington said March 19. State case law provides that an employer’s obligation to accommodate a worker’s disability doesn’t end when the worker’s employment ends, the court said.
